This Terms of Service document is here to inform you about the rules that govern the website GETitSELLit.com. GETitSELLit.com is an online web property (website) owned and operated by Definitely Incorporated. This document was last updated on January 12, 2006.
Definitely Incorporated operates the website GETitSELLit.com which is an online marketplace that promotes commerce and job related interacteions between people. It includes the functionality for people to post classified advertising, (referred to hereafter as "the Service"). The Service is subject to the following Terms of Service. When details of the Terms of Service, ("Terms"), are updated notice will be posted on GETitSELLit.com.
By using the GETitSELLit.com website you are indicating that you agree with these Terms of Service. You are also indicating that you will abide by these terms whhen using GETitSELLit.com.
Membership is limited to one account per person. Your account may be canceled by the GETitSELLit.com management at any time for any reason. By enrolling in a GETitSELLit.com membership you agree to these terms an conditions and the privacy policy. There are currently four levels of Membership:
Free Membership
Anyone over the age of 18 and who has a valid email address can enroll in a Free Membership. Free memberships entitle you to a variety of features.
Power Membership
The Power Membership is a paid membership subscription which entitles you to additional features and functionality. The current cost of the power membership is $4.85 per month. Billing is automated through PayPal. Power Membership subscriptions may be canceled by canceling the subscription via your PayPal account.
Lifetime Power Membership
Definitely Incorporated is offering GETitSELLit.com Lifetime Power Membership subscriptions for a limited time. The current cost of the Lifetime Power Membership is a one time payment of $58.20. Terms of Lifetime Power Membership subscriptions are subject to additional conditions as outlined in this section.
A Lifetime Power Membership subscription runs for the life of the person subscribing. During that time, Definitely Incorporated will provide the service via GETitSELLit.com as described in our Terms of Service. Lifetime Power Membership subscriptions are not transferable, although this may change in the future. If Definitely Incorporated is to go out of business the subscription ends. Definitely Incorporated may terminate a lifetime subscription at any time by returning part of all of your original purchase price, currently $58.20.
In the event of an acquisition of Definitely Incorporated, change of control of Definitely Incorporated, significant merger, or other legal reorganization, Definitely Incorporated may terminate lifetime subscriptions by returning part of all of your original purchase price. If Definitely Incorporated terminates your account because of a violation of our Terms of Service, Definitely Incorporated will not refund your subscription price. Definitely Incorporated may change the limits of lifetime accounts from time to time to reflect costs. Other additional services may be offered for additional cost.
If your GETitSELLit.com lifetime subscription account has no activity for a period of two(2) years we will consider that account dormant and will remove online access to the data. We will then keep the data for an additional unspecified period of time, at which point we will delete your data. Activity is defined as the addition of new data or the access of old data via the web, excluding traffic generated by search engines and other automated crawlers.
You can cancel your lifetime subscription. If you cancel your subscription, we will remove your data from our servers within 30 days of your cancellation.
Moderator Membership
Moderator Memberships are given to select individuals selected by GETitSELLit.com management. As the title implies, this provides additional features and functionality that allow the member the ability to act on other members posts on behalf of the GETitSELLit.com management. Moderator Memberships are subject to these Terms of Service and can be canceled at any time for any reason.
You are entirely responsible and liable for the information, images, photos, flags, feedback comments, video, sound, links, messages, ("Content"), you post via the Service. You are solely responsible for the Content you post. Definitely Incorporated is not responsible for the Content delivered thorugh the Service. Definitely Incorporated also makes not guarantee that Content posted or linked to via the Service is authentic or accurate. You use the Content available via the Service at your own risk and you accept full responsibility for any risks and results of the use of the Content. You also accept that under no circumstances will Definitely Incorporated be held liable in any way for any loss or damage of any kind incurred as a result of the use of any Content made available via the Service. If you suspect Content is not in compliance with these Terms you are encouraged to flag the post for review by a GETitSELLit.com staff member. GETitSELLit.com management reserves the right to remove any Content that does not comply with the Terms but is not obligated to remove any Content. The following are examples of the types of Content that is not acceptable and is subject to removal.
Duplicates
Do not post duplicate ads for the same item. These posts will be removed when discovered.
Schemes
Do not post ads that contain or link to multi-level-marketing programs, affiliate marketing programs, get-rich-quick programs, bulk email programs, chain letters, or link referral programs. These posts will be removed when discovered.
Non-Kid Friendly
GETitSELLit.com does not review or pre-screen all posts. By posting Content via the Service, you agree to keep it acceptable for persons under the age of 18 years of age. GETitSELLit.com makes no warrenties or guarantees that the Content available via the Service will be acceptable for persons under the age of 18 years of age. We require that users of the Service must be at least 18 years of age. We will remove posts from people under 18 years of age. If you are under the age of 18 please seek the assistance of a parent or guardian.
Illegal
By posting Content via the Service, you agree to keep it legal. No illegal goods or services may be posted on GETitSELLit.com. These posts will be removed when discovered.
Harmful To Life
By posting Content via the Service, you agree to keep it safe to life. No dangerous goods or services may be posted on GETitSELLit.com. These posts will be removed when discovered.
You many not post Content that conflicts with the intellectual property rights of others. If you suspect that your intellectual property rights have been infringed upon please contact us immediately and report the abuse. GETitSELLit.com management will remove any posts that infringe on someone elses intellectual property rights, subject to the Digital Millenium Copyright Act (DMCA).

You are entirely responsible and liable for all postings to GETitSELLit.com. Listed below are some, though not all, violations which may result in GETitSELLit.com management deleting your postings & account. You agree not to do any of the following requests while posting ad(s) to GETitSELLit.com:
By using the Service you understand and agree that GETitSELLit.com management may limit the duration and size of posts including the physical size of photos and posts. You also understand and agree that there is no guarantee that the service will be functional and available at all times.
You expressly agree that use of GETitSELLit.com is at your own risk. Definitely Incorporated shall not be responsible to you for any Content found on GETitSELLit.com. Definitely Incorporated expressly disclaims all warranties of any kind, whether implied warranties of merchantability, fitness for a particular purpose, and noninfringement. Definitely Incorporated makes no warranty that GETitSELLit.com will be timely, secure, error free, or meet your requirements; nor does Definitely Incorporated make any warranty as to the results that may be obtained from the use of GETitSELLit.com or as to the accuracy or reliability of any information obtained through GETitSELLit.com. No advice or information, whether oral or written obtained by you from GETitSELLit.com shall create a warranty not expressly made herein. You understand and agree that any Content downloaded or otherwise obtained through the use of GETitSELLit.com is done at your own discretion and risk and that you will be solely responsible for any damages to your computer or loss of data that results in the downloads of such Content. To the full extent permissible under the applicable law, Definitely Incorporated shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use GETitSELLit.com or for the cost of procurement of substitute goods and services resulting from any goods or services purchased or obtained through your use of the GETitSELLit.com classified ads system.
You agree that under no circumstances will Definitely Incorporated be held liable for any indirect, direct, special, incidental, consequential or exemplary damages including circumstanses where Definitely Incorporated had been advised of the possibility of such damages, that result from any indirect use, durect use, misuse, interruption, modification, suspension, alteration, or termination of the Service. This limitation will also apply to damages incurred by the use of other services, products advertised in, linked to, or received through Content via the Service. These limitations will apply to the fullest extent permitted by law. In some jurisdictions some limitations of liability are not permitted, in which case some of the limitations listed above may not apply to you.
You agree to defend, indemnify, and hold harmless Definitely Incorporated, its officers, partners, directors, employees and agents, from and against any claims, actions or demands, including without limitation, reasonable legal, accounting fees and court costs resulting from use of the Service and Content or your breach of the terms of the Terms.
